By accessing or using the OpenAI4Africa Foundation’s websites, apps, AI products, services, and offerings (collectively “Services”), you agree to be bound by these Terms of Use and our Privacy Policy. If you disagree, do not use the Services.

2. Eligibility

Adult Users (18+ or age of majority): You confirm you are an adult with the capacity to agree.
Teen Users (13-17): You must provide proof of age and have parental consent where required.
Child Users (Under 13): You must have verifiable parental/guardian consent to create an account and use the Services.

3. Accounts & Conduct

You agree to provide accurate registration details, use a single account in your real name, keep your login credentials secure, and comply with our Acceptable Usage Guidelines prohibiting illegal, abusive, harassing, infringing, many-shot jailbreaking unless for experimental/ educational purposes or disruptive conduct on the Services.

4. School/Institutional Use

For use by educational institutions, additional terms apply regarding consent, privacy law compliance, such as FERPA/COPPA, and limiting usage to educational purposes only.

5. User Content

You retain ownership of the content you submit, but you grant us a perpetual license to use, copy, modify, and share it. Don’t share illegal, harassing, copyright-infringing, or unauthorized content.

6. Limited License

We grant you a limited, revocable license to access the Services only for personal, non-commercial use. Modifying, redistributing, or creating derivatives of our Services or materials is prohibited.

7. Third-Party Content

We do not control or endorse any third-party content, apps, sites, or services linked to our Services. We only have control over our partners/ main partners.

8. Location Services

You consent to our transmission, collection, and processing of your location data to provide and improve location-based Services on your devices.

9. Copyright & Takedowns

We will respond to legitimate takedown notices for copyright violations by removing infringing content.

10. Disclaimers

We provide the Services “AS IS” without warranties. Our Services should not substitute medical/professional advice.

11. Limitation of Liability

OpenAI4Africa’s total liability is limited, and we disclaim indirect damages to the maximum extent permitted by law.

12. Indemnity

You agree to indemnify us against legal claims for your violating conduct on the Services.

13. Termination

We may discontinue or terminate the Services or your access at any time. Specific terms survive termination.

14. Disputes & Governing Law

Any disputes are subject to binding arbitration per JAMS rules. California law applies.

15. Updates

We may update these Terms. Your continued use of the Services means you accept the revised Terms.
